WAIVER OF LIABILITY, RELEASE, AND INDEMNITY AGREEMENT
BETWEEN:
Bairro 124 Brazilian Jiu-Jitsu Ltd. (operating as Bairro Brazilian Jiu-Jitsu Academy)
Bairro Martial Arts Ltd. (operating as Bairro Martial Arts Academy South)
(Collectively referred to as "Bairro")
WARNING! BY SIGNING THIS FORM YOU GIVE UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. THIS WAIVER DOES NOT EXPIRE.
1. Disclaimer & Description of Risk: I acknowledge that Bairro is not responsible for any injury, death, loss, or damage suffered by any person participating in the Program. I am aware that Brazilian Jiu-Jitsu and Martial Arts involve strenuous physical activity and substantial bodily contact which carries significant risk of physical injury.
2. Infectious Disease & Skin Infection Acknowledgment: I fully understand that the martial arts environment involves close physical contact. I acknowledge the inherent risk of contracting communicable diseases, viruses, or skin infections (including but not limited to Staph, Ringworm, or Impetigo). I agree to self-screen for symptoms or lesions daily and will refrain from training if I am symptomatic. I voluntarily assume all risks related to such exposure.
3. Release of Liability & Waiver of Claims: I hereby agree to WAIVE ANY AND ALL CLAIMS that I have or may in the future have against Bairro 124 Brazilian Jiu-Jitsu Ltd. and Bairro Martial Arts Ltd., their officers, directors, agents, and employees. I RELEASE Bairro from any and all liability for any loss, damage, expense or injury, including death, that I may suffer as a result of my participation in the Program DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE.
4. Indemnification: I agree to HOLD HARMLESS AND INDEMNIFY Bairro from any and all liability for any property damage or personal injury to any third party resulting from my participation in the Program.
5. Binding Effect: This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, and representatives in the event of my death or incapacity.
6. Physical Condition: I certify that I am in good physical condition and have not been advised by a medical professional to avoid contact sports.
